A new report by the Washington Traffic Safety Commission (WTSC) states that pot or marijuana use has been linked to fatal crashes. The fatal crashes involved drivers who also had more than 0.08 BAC or blood alcohol levels. However, their elevated levels of THC make officials suspect that they had used marijuana within a few hours of the fatal crash.
Lack of clarity
Washington is one of four states in the country to have legalized recreational marijuana use. However, there are no clear federal rules on determining the amount of marijuana in the blood to determine intoxication. Under Washington laws drivers can drive with under 5 nanograms per milliliter of THC in their blood. However, Washington police do not have a marijuana equivalent of a breathanalyzer and this makes your Seattle, WA drunk driving and marijuana lawyer quite happy.
Instead they depend on field sobriety tests and a blood test. While some states have a zero tolerance policy for marijuana use, others have a lower limit. Washington police believe that the increased use of marijuana will increase the danger of fatal crashes on the roads unless drivers are warned on the dangers.
