Police in Pelham Arrest Pickup Driver on DUI Charges after Accident
Police in Pelham have arrested a pickup driver who passed out behind his wheel on charges of a DUI after he hit a van. The accident occurred on Atwood Road near Old Lawrence Road in Pelham at around 7:30 pm. The van driver called the police after the pickup truck hit the rear of the van.
Drunk Driving, Lane Violation
According to the van driver, who called the police, the pickup truck driver, later identified as Kevin Bolia of Pelham, was driving head on toward the van and even swerved lanes. The van driver tried to avoid the pickup by driving into a snow pack but the pickup still managed to hit the rear of the van.
The van driver also told the police who responded to his call that he believed the driver of the pickup was intoxicated. According to the van driver, the pickup truck came toward his van and changed lanes as well. Even though the van driver tried to move his van away from the path of the truck he was unable to do so completely and the pickup truck managed to hit the rear of the van.
Intoxicated and Passed Out
According to Officer David DeRoche, he found the Chevrolet 1999 pickup truck with damages in the driveway of Yarde Metals off Atwood Road. Bolia was still behind the wheel, but had passed out. When DeRoche woke Bolia up he lifted his foot of the brake and the truck started moving forward. Bolia was then unable to stop the truck and DeRoche had to reach into the truck to shift it to park. DeRoche did this to prevent further damage.
Charges Framed
Bolia was arrested on charges of driving under the influence of drugs and has also been charged for violating marked lanes after the police investigated the accident scene. He has also been charged with a second offense of driving under the influence. Bolia now faces three charges related to the drunk driving accident that occurred on Atwood Road. It is not looking good for Bolia right now.
Legal Help
When a person is arrested on drunk driving charges they face multiple penalties. They can be imprisoned, fined, and their driving license suspended. The severity of the penalties imposed depends on multiple factors such whether this is a first offense or not and whether the drunk driver was using a commercial license.
Those who are convicted a second or third time on a drunk driving charge face greater penalties and their driving license can also be revoked. Additionally, the insurance premium of people convicted of a drunk driving charge goes up, adding to the financial burdens.
Moreover, the convicted driver or their insurance company will have to pay compensation to the other driver for injuries and damage to the car.
If you have been arrested on a drunk driving charge you need to retain the services of an experienced drunk driving attorney who will assess the evidence against you and the circumstances of the accident to help reduce the charges, penalties, and compensation that could possibly be owed.
