Arkansas Man Charged With DUI And Negligent Homicide
20 year old Alfred Cuanas Pascual was arrested by Arkansas State Police on January 23rd for driving under the influence. Pascual has been charged for negligent homicide, DUI, and reckless driving that resulted in the death of one in Bryant on Thanksgiving Day.
Pascual Admitted to Driving Under Influence
A November 28th crash report states that Pascual was driving west on Interstate 30 on the north service road in a 2008 Ford Mustang around 6:15 am. The car crossed the median after running off the road and stopped on Interstate 30 facing north across a lane.
24 year old Jenna Nicole Kelton of Alexander was driving west on Interstate 30 in a 2015 Nissan Altima when her vehicle crashed into the Mustang. Kelton died of her injuries later.
Pascual suffered injuries as well and was taken to an area hospital for treatment. The authorities claimed they smelled alcohol on him while asking questions about the car crash. He admitted to drunk driving as per a court affidavit. Pascual’s blood alcohol content tested at 0.026 and 0.03 as per the affidavit.
Arkansas Law Treating Pascual as Underage
The legal limit of blood alcohol concentration is 0.08. Under Arkansas law, people charged with drunk driving, DUI and DWI under the age of 21 years have a different set of penalties and rules. Underage people can be charged with DUI when their blood alcohol concentration is 0.02 and above.
However, Pascual was not on the Saline County jail roster. The Saline County prosecuting attorney’s office said he has a court date for February 25th.
Another Deadly Crash on Thanksgiving Day
There was another deadly crash on I-30 in Bryant on Thanksgiving Day. Two people were left injured and three dead in the eastbound lane near exit 123. Authorities claim that crash was a result of a rear-end collision according to preliminary investigations. All victims were riding in the same car.
Understanding Arkansas Drunk Driving Laws
Arkansas has different DUI laws for different drivers based on their age and the vehicle they were operating. This makes it important to speak with a capable drunk driving accident lawyer as soon as possible. While the legal blood alcohol limit is 0.08, for people under the age of 21 years it is 0.02.
Also, underage drivers can be charged with DWI if their blood alcohol concentration is more than 0.02 but less than 0.08. An experienced DUI lawyer can help offenders understand the laws that apply to them. Skilled drunk driving accident attorneys can help find the best approach to navigate lawsuits.
DUI attorneys treat commercial vehicle operators differently because they can be charged if their blood alcohol concentration is 0.04.
