Virginia Woman Awarded $8 Million for Drunk Driving Accident

In a recent case, a jury in civil court awarded a Virginia woman who suffered a traumatic brain injury in a drunk driving accident $8 million in personal injury compensation.

After five days of trial, a Massachusetts-based company, Clean Harbors Environmental Services Inc., agreed to pay the 56-year-old woman $8 million after one of their workers hit her in a 2014 drunk driving accident. The settlement was reached just a day before the jury was slated to begin deliberations, the Daily Press reports.

Clean Harbors Environmental Services Inc. had several workers in Virginia after being awarded a contract to clean tanks at a York County facility. The company had eight out-of-town employees working on the project.

On August 27, 2014, one those employees, a 58-year-old Houston native, got into a company truck after a day of drinking and ran into the plaintiff’s car, according to the Daily Press. The crash occurred around 8:30 p.m., as the plaintiff slowed for a red light. The defendant didn’t slow his truck and rear-ended the defendant. The woman’s Lexus was pushed into another car, causing her to hit her head. Because of the crash, she suffered a mild TBI, along with back and neck injuries.

Many victims of traumatic brain injuries are often unable to work and must relearn many skills including the basics such as walking and talking.

The plaintiff’s lawsuit alleges that Clean Harbors Environmental Services Inc. was negligent because all workers on location were permitted to drive the company truck with no supervision. The complaint states Clean Harbors, “failed to use reasonable care and were negligent in the operation of the truck,” the Daily Press reports.

The attorneys representing the plaintiff told the Daily Press that their client, who is a former nurse, is no longer able to work and has been forced to relearn skills most of us take for granted.

The Cost of a Brain Injury

Car accidents are the third leading cause of brain injuries in the U.S., the Centers for Disease Control says. Not all people with a traumatic brain injury will have permanent damage, but currently, 5.3 million Americans are living with a TBI-related disability, according to the CDC.
